These Terms & Conditions explain your rights and obligations and will apply to all visits and use of this website. When you access and use this website you signify your consent to our Terms & Conditions in their entirety, in addition to any other law or regulation that applies to our website. A contract will only exist for the sale of goods or services when Clear Chemist accepts your order. Ownership of products will pass to you when Clear Chemist receive payment in full. Clear Chemist reserves the right to change these Terms & Conditions at any time, with immediate effect, by displaying any changes on our website.    

Terms & Conditions of Trade Business Definitions:

“the Contract” refers to any Contract to which these terms and conditions apply

You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.You understand that you, and not us are responsible for all electronic communications and content sent from your computer to us and you must use the Website for lawful purposes only.You must not use the Website for any of the following:

  • for fraudulent purposes, or in connection with a criminal offence or other unlawful activity.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to the Website, policies, and terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use the Website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

 

Price and Offers

All prices and offers on the Website are subject to availability whilst stocks last. If the stock is exhausted then we will contact you with the new price and you will pay or be refunded the difference. Alternatively, you may be given the opportunity to cancel your request.

Only one discount offer or code/voucher may be used with each transaction.

The price shown on the Website is inclusive of VAT at the prevailing rate.

We as company can cancel orders and refund customers' money because of pricing errors, we are not obliged to fulfil orders if the price is too low, known as 'unilateral mistake of fact'.

The Website is regarded as an invitation to treat. Orders placed are an offer to purchase which we may accept or decline at our absolute discretion without needing to give any reason for declining the offer to purchase. A confirmation email is automatically sent which confirms receipt of the offer to purchase. This does not constitute acceptance of the offer to purchase. A contract is deemed to have been entered into when we issue a sales invoice or a delivery invoice. Our pharmacy team will check all orders before release and before issuing a sales invoice or a delivery invoice.

Once the order has been placed on the Website the transaction is manually processed at our premises by our registered pharmacist.

We can only process prescriptions from an original prescription. Once you have placed your request for supply the original prescription must be sent to us at our registered address. We cannot dispatch any order until the original prescription has been received by us and checked by our pharmacist.

 

Checkout of some products

1. Some products will be indicated as age restricted. These products will require you to supply your date of birth at checkout and complete an age check so we can be 100% sure that the person buying the product is you. These products mainly are medication and potentially abusive products.

2. Some products can be paraffin based which is associated with the risk of fire. We will ask you on these products, to read the warning tab, which is indicated below before checking out with the purchase of this product.

Fire hazards with paraffin-based and paraffin-free skin products
You have been provided this information because we are supplying you with a paraffin-based/emollient product which is associated with a risk of fire.

If you are using an emollient, particularly a paraffin-based skin product, which is covered by a dressing or clothing, there is a danger that smoking, or presence around a naked flame, could cause your dressing or clothing to catch fire.

Listed below are some important points to consider:

• Do not smoke, use naked flames (or be near people who are smoking or using naked flames) or go near anything else which may cause a fire whilst the emollient are in contact with your clothes, dressing or bandages (for example, do not lean over a lit gas cooker or candle or do not allow lit cigarettes to touch clothing or dressings)
• Ensure that your clothes and bedding are changed regularly (preferably daily) as the paraffin can soak into fabric and can potentially be a fire hazard
• Wash the bedding and clothing at high temperature (between 60-90 degrees Celsius) to reduce the build-up of paraffin; avoid wearing delicate garments when using emollient creams as they cannot be washed at high temperature without causing damage
• Be careful to make sure that the paraffin does not soak into chairs, seating or other furniture by covering them with a throw that can be daily washed
• Tell your relatives or carers about your treatment and show them this leaflet
• Tell your doctor, nurse or pharmacist if you normally smoke as they will be able to offer you help and advice to stop smoking

Your treatment is important, but it is essential that you are kept safe when you use these prescribed products. By following the advice above, you will help us to make sure that you using these products safely.

Basis of Sale

These Terms & Conditions are the only terms and conditions to which the contract for the sale or supply of the Goods by the Company to the Customer is subject.  Unless expressly agreed in writing and signed by a Director of the Company, any other conditions proposed or stipulated by the Customer in whatever form, written or oral, are hereby expressly waived or excluded.  Acceptance of the Company’s quotation for the sale or supply of the Goods or Services implies an unconditional acceptance of these terms and conditions. All prices quoted are subject to VAT.  No contract shall be or become subject to any contrary conditions of the Customer by reason of the failure of the Company to respond or object to any such conditions contained in or within any document delivered by the Customer. 

Terms of Payment

The Contract price is, unless expressly agreed, IS INCLUSIVE of Value Added Tax and local duties, where applicable.  The time of payment of the Goods invoiced shall be the essence of the Contract.  In the event of the cost to the Company of materials and/or production being increased after the date of contracting by circumstances beyond the control of the Company, the Contract price shall be increased by such sum as the Company will advise.  The Company shall not be liable to the Customer for any loss or damage due to any delay in the delivery of the Goods.  Should the Customer fail to make any payment on the due date then, without prejudice to any other right or remedy the Company shall be entitled to withhold delivery of further goods, without incurring liability, and charge the Customer interest (before and after any judgement) on the amount unpaid, at the rate of 2.5% per annum above  Natwest plc base rate or according to statutory legal requirements in force at that time until payment is received in full.  Unless expressly agreed, all sums shall be payable in sterling, if the sum payable is agreed in a currency other than sterling, the amount payable shall be subject to an increase to reflect any devaluation of such currency in relation to sterling after the date of the Contract or order date. 

Delivery (Postage and Packaging)

It is your responsibility to enter the correct delivery address at the time of ordering. If the incorrect address is given, we are not obliged to re-send the order to the correct address at our expense. You are advised to contact the Customer Services Department immediately if you make a mistake with your delivery address as once an item is shipped the address cannot be amended.

Once an order has been placed if, for any reason, we are unable to ship any part of it, we may at our discretion, send part of the order that is in stock or remove item(s) from the order. In this instance, a refund will be made to you and a note made on the invoice enclosed within the package.

All delivery dates are estimates and NOT guaranteed. Please note not every item is eligible for Special Next Day Delivery, the Customer Services Department will contact you if this option is selected but cannot be fulfilled.

Whilst we reserve the right to use any form of delivery and packaging, generally, any packaging will be discreet with a plain outer package.

We reserve the right to use whichever form of delivery we deem appropriate.

Postage and Packaging for all NHS prescriptions is free of charge. . Your products will not be despatched until the original prescription is received and checked by us.

Delivery within the UK - Store items and Over The Counter products

Dispatch is usually within 1-3 days from ordering. The 3-5 working days for tracked and signed delivery is on top of the dispatch timescales. 

Standard Delivery is via Royal Mail using the Tracked service which is a 48-hour fully tracked service from despatch and is not guaranteed. This service cannot be used for orders containing more than 2 aerosols.

Royal Mail will not allow more than 2 aerosols to be sent in each package, therefore orders containing more than 2 aerosols must be sent using our alternative courier – DPD (potentially with an extra charge). We cannot deliver aerosols internationally, to Northern Ireland or to the offshore islands of England and Scotland. We can, however, still deliver to the Scottish Highlands mainland but due to a change of courier service a postage charge may occur, please call our Customer Services Department for more information on 0151 203 6535

Postage and packaging is charged at £3.99 for UK orders up to a value of £50. Standard orders with a value over £50 will be free of charge unless stated in the specific item description. Tracked & Signed and Next Day Delivery packages must be signed for at the delivery address. If for any reason, a package is returned to us then you are responsible for any redelivery costs incurred. If you then decide to cancel the order, only the cost of the goods will be refunded.

Heavy items will be sent using our alternative courier, DPD. Additional charges may apply. The Customer Services Department will contact you if this is the case.

 

Lost or Missing Packages

Royal Mail - A package can only be reported as missing to Royal Mail if it has not arrived within 15 working days (3 weeks). Most missing items are located within the postal system within this time period. If after 15 days an order has still not been received, you are advised to contact our Customer Service Department on 0151 203 6535 with your order number and full name and address. The Customer Services Department will then issue a claim with Royal Mail. Our Customer Service department will then arrange to either refund or resend the order.

DPD - A package should be received the day after shipping. If you are not available then the courier will leave a card for you to rearrange delivery to a more convenient time. If you do not receive your package or a courier card within 2 – 3 days of receiving our dispatch email or you experience any difficulties with rearranging delivery then please contact our Customer Services Department.

Prescription Orders - If your prescription order is lost, then we understand that this time frame to wait can be inappropriate. So we advise that you obtain another prescription and re-order your items again. Once we successfully claim from Royal Mail / DPD, or they find your original items, we will refund you for the previous order.

 

Returns and Exchanges

Packages returned by postal services - If an item is returned back to us for any reason, we will attempt to contact you to arrange to resend this. If you then decide to cancel the order, only the cost of the goods will be refunded.

Return of unwanted items - It is your responsibility to contact our Customer Service Department on 0151 203 6535 to advise of your intention to return or exchange any item(s) within 14 calendar days of receipt and to obtain an Authorised Returns Number. After this date, it is solely within our discretion if a return or exchange will be accepted. Once we have approved a return then all items must be received no later than 14 days from the date of the return number being issued.

Once opened and/or used, products cannot be returned unless they are faulty or broken. In addition, products of a cosmetic, medicinal or personal nature cannot be returned due to hygiene reasons. Returned items will only be refunded if they are in a saleable condition upon return. We may reduce the amount of money refunded for goods returned that show evidence of use beyond the necessary handling to see whether the goods are as expected. If the original order was sent free then you are liable for the cost of returning items. Alternatively please call 0151 203 6535 to request a returns label. It is highly recommended that items are returned via a Recorded Delivery service as we do not accept responsibility for items lost in the post. It is your responsibility to ensure that the goods are adequately packaged to ensure that they are not damaged during return transit.

Return of faulty or damaged items - You are advised to contact our Customer Service Department on 0151 203 6535 to advise of your intention to return faulty or damaged items and to obtain an Authorised Returns Number. You should provide your order number, name, address and the reason for the return. If items are returned without an Authorised Returns Number then we are unable to offer an exchange. It is highly recommended that items are returned via a Recorded Delivery service as we do not accept responsibility for items lost in the post. In the event that no fault is found with the items, we reserve the right to recover any fees and/or expenses incurred from you.

Products of a cosmetic, medicinal or personal nature cannot be returned due to hygiene reasons. 

Faulty items will be accepted in accordance with the Manufacturer’s warranty terms. This does not affect your statutory rights.You can refuse delivery for a damaged item, in this instance, you must notify our Customer Services Department within 7 days as stated above.

 

Failed Deliveries

If an item is returned due to failed delivery we reserve the right to charge £3.99 for re-delivery.

 

Title & Risk

All Goods purchased by the Customer shall remain the property of the Company until the Customer has paid for the respective Goods in full.  Although Goods remain the property of the Company until paid for, the risk of the Goods shall pass to the Customer.  Goods delivered to the Customers’ vehicle or premises or as requested, are deemed to be at the risk of the Customer and should be insured by the Customer against all risks.  In the event of any claim arising under insurance, all proceeds accruing shall be held in trust for the Company.  The Customer's right to possession shall cease if the Goods are not paid in full by the due date as stipulated in the Terms of Payment. 

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

on which you acquire or a third party other than the carrier and indicated by you acquires physical possession of the goods

To exercise the right to cancel, you must inform Clear Chemist, Unit 20 Brookfield Trading Estate, Brookfield Drive, Liverpool L9 7AS, customerservices@clearchemist.co.uk of your decision to cancel this contract by a clear statement.

Deadline

To meet the cancellation deadline it is sufficient for you to send your communication concerning your exercise of the right to cancel before the period has expired.

Effects of Cancellation

If you cancel this contract we will reimburse to you all of the payments received from you including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type offered by us).

We may make a deduction from the reimbursement for loss of value of any of the goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and no later than-

(a)   14 days after the day we receive back from you any goods supplied, or

(b)   (if earlier) 14 day after the day you provide evidence that you have returned the goods, or

(c)   If there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise: in any event you will not incur any fees as the result of the reimbursement.

Retention of reimbursement

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Return of goods

You shall send back the goods to Clear Chemist, Unit 20 Brookfield Trading Estate, Brookfield Drive,  Liverpool L9 7AS, without undue delay and in any event no longer than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days expired.

Return Cost

The customer will have to bear the direct cost of returning the goods.

Consumer liability for diminished value of the goods

The customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right to cancel

Products of a medicinal, cosmetic or personal nature cannot be returned due to health protection and hygiene reasons.

The majority of orders we receive before 4:00pm are picked and dispatched on the same day. In order to meet these time scales we aim to process all orders immediately, it may be too late to cancel your order but you may return any unwanted item for a refund provided it complies with the above terms.

Private Prescriptions

If a private prescription is ordered and paid for, and subsequently cancelled by the customer this will be subject to a £5 (FIVE POUND) administration charge regardless of the prescription value.  This is to cover administration and merchant charges.  Private Veterinary prescriptions are subject to VAT and we will contact you when we receive your prescription to arrange payment prior to dispatch.

Promotions

Promotions or offers of any kind will never apply to prescription-only medicines under any circumstances.

Errors and Omissions

Whilst the Company take every care in compiling Company literature, no responsibility can be accepted by the Company for any errors.  We reserve the right to alter product specification and price without notice. 

Company

Any Goods which the Customer has deemed to be defective and/or unfit for a specific purpose and so proven to the Company’s reasonable satisfaction, after notifying the Company in writing where the Goods are preserved and are available for inspection and ensuring that said goods are not altered or subjected to any conditions adversely affecting their condition; the Company shall be liable to replace or at their sole discretion reimburse the Contract price thereof together with any proper expense incurred returning the Goods to the Company but shall not be liable to the Customer for any other loss or damage.

This website is owned and operated by Clear Chemist.
